I. INTRODUCTION In Prometheus Radio Project v. Federal Communications Commission, (1) the Third Circuit reviewed the media cross-ownership limits proposed by the Federal Communications Commission ("FCC"). (2) The Third Circuit critically examined the FCC's use of a "Diversity Index" to reach its proposed rules (3) and then remanded the Cross-Media Limits to the FCC for justification or modification. (4) Given this somewhat unusual decision--a court not deferring to an administrative agency on a technical rule-making issue--there has been surprisingly little reaction from the academic community.
